As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? Two recently published collections of essays—Free Will and Theism, edited by Kevin Timpe and Daniel Speak, and Free Will and Classical Theism, edited by the late Hugh McCann—represent the state of the art in current analytic philosophy and analytic theology with respect to issues at the intersection of the metaphysics of free will and Christian theism that have vexed philosophers and theologians throughout Christian history. Despite a marked imbalance of incompatibilist authors over compatibilist authors in both volumes, the essays in (...) these collections advance the discussion in significant ways, and I indicate some of those ways. The renaissance of pragmatism in recent decades has stimulated renewed study of the classical pragmatists. Until this volume, F. C. S. Schiller was the only major pragmatist from the classical era whose significant writings remained uncollected for renewed scholarly study. The forty-two pieces in this collection represent Schiller's finest writings. They range across a broad spectrum of specific topics: logic and scientific method, meaning and truth, pluralism and monism, personalism and idealism, metaphysics and values, evolution and religion, and ethics and (...) politics. We reflect, using a vignette, on conceptual tensions and the value judgements that lie behind difficult decisions about whether or not the older person with dementia should return home or move into long-term care following hospital admission. The paper seeks, first, to expose some of the difficulties arising from the assessment of residence capacity, particularly around the nature of evaluative judgements and conceptual tensions inherent in the legal approach to capacity. Secondly, we consider the assessment of best interests around place (...) of residence, which demonstrates significant conceptual tensions. In addition, ‘best interests’ raise issues around the perception of risk and the perceptions of the family and crucially involve the notions of autonomy and trust. Finally, we not only gesture at some practical considerations based on insights from values-based medicine, but also make the suggestion that we require tighter functional assessments of residence capacity coupled with broader judgements about best interests. The coronavirus disease-2019 (COVID-19) has caused shortages of life-sustaining medical resources, and future waves of the virus may cause further scarcity. The Yale New Haven Health System developed a triage protocol to allocate scarce medical resources during the COVID-19 pandemic, with the primary goal of saving the most lives possible, and a secondary goal of making triage assessments and decisions consistent, transparent, and fair. We outline the process of developing the protocol, summarize the protocol, and discuss the major ethical challenges (...) encountered, along with our answers to the challenges. These challenges include (1) the role of age and chronic comorbidities; (2) evaluating children and pregnant patients; (3) racial, ethnic, and socioeconomic disparities in health; (4) prioritization of healthcare workers; and (5) balancing clinical judgment versus protocolized assessments.We conclude with a review of the limitations of our protocol and the lessons learned. We hope that a robust public discussion of such protocols and the ethical challenges they raise will result in the fairest possible processes, less need for triage, and more lives saved during future waves of the pandemic and similar public health emergencies. C.B. Macpherson's “Possessive Individualist” reading of Locke is one of the most radical and influential interpretations in the history of exegesis. Despite a substantial critical response over the past five decades, Macpherson's reading remains orthodox in various circles in the humanities generally, particularly in legal studies, and his interpretation of several crucial passages has unwittingly been followed even by his sharpest critics within Lockean scholarship. In order to present the definitive rebuttal to this interpretation, and so finally to lay it (...) to rest, I argue that every one of Macpherson's key pieces of textual evidence can be rejected entirely on its own terms; that is, by reference to no more than its immediate context. In this way I contend that fault of the Possessive Individualist reading lies far deeper than mere cherry-picking of the Lockean corpus, but centrally involves misreading, misplacing and misrepresenting the very parts of Locke's work Macpherson cites as evidence for his reading. For many years, the downtown in Clarksdale, with a municipal population of 17,960 and located in the northern part of the Mississippi Delta, had lost its role as the centre providing a wide range of jobs and services to those living in the surrounding region. For many cities and towns in America, downtown decline has been associated with the flight to the suburbs and the growth in shopping malls serving flourishing gated communities. In Clarksdale’s case, downtown decline has been due (...) largely to the advent of big box retailing and the location of new retail and commercial developments along the state highway on the edge of town, combined with the loss of jobs and population associated with agricultural restructuring. Today, however, Clarksdale has taken up the challenge to ‘revitalize’ the downtown in the face of economic adversity. Recovery is under way, and much of this is associated with blues music and Delta culture: Clarksdale is situated at the fabled ‘crossroads’ of Highways 49 and 61 and is also the home to national icons in literature, art and other cultural pursuits. These are key elements around which the downtown revitalization effort is focused. This paper charts the process by which the Clarksdale community has embarked on the road to downtown recovery, and highlights the town’s indelible links with the blues, borne out of years of toil, hardship and social deprivation. The paper emphasizes the importance of ‘champions’ and ‘creative people’, drawing on community support, in achieving downtown revitalization. Positive results are becoming evident with new businesses and jobs, improved levels of service, refurbishment of derelict buildings, a renewed sense of place, and an uplift in community confidence. The significance of cultural tourism to downtown revitalization is highlighted, with particular emphasis on the global appeal of blues, but with its roots firmly established in Clarksdale and the Delta. It is argued that mathematical statements are "a posteriori synthetic" statements of a very special sort, To be called "structure-Analytic" statements. They follow logically from the axioms defining the mathematical structure they are describing--Provided that these axioms are "consistent". Yet, Consistency of these axioms is an empirical claim: it may be "empirically verifiable" by existence of a finite model, Or may have the nature of an "empirically falsifiable hypothesis" that no contradiction can be derived from the axioms.

One of the paradoxes of the physical sciences is that as our knowledge has progressed, more and more diverse physical phenomena can be explained in terms of fewer underlying laws, or principles. In Hidden Unity, eminent physicist John Taylor puts many of these findings into historical perspective and documents how progress is made when unexpected, hidden unities are uncovered between apparently unrelated physical phenomena. It explores the history of passport laws, the parliamentary debates about those laws, and the social responses to their implementation. The author argues that modern nation-states and the international state system have 'monopolized the 'legitimate means of movement',' rendering persons dependent on states' authority to move about - especially, though not exclusively, across international boundaries. Civility is an essential feature of health care, as it is in so many other areas of human interaction. The article examines the meaning of civility, reviews its origins, and provides reasons for its moral significance in health care. It describes common types of uncivil behavior by health care professionals, patients, and visitors in hospitals and other health care settings, and it suggests strategies to prevent and respond to uncivil behavior, including institutional codes of conduct and disciplinary procedures. The article (...) concludes that uncivil behavior toward health care professionals, patients, and others subverts the moral goals of health care and is therefore unacceptable. Civility is a basic professional duty that health care professionals should embrace, model, and teach. (shrink)

The concept of the sick role entered sociology in 1951 when Talcott Parsons creatively separated the sick person out of the doctor–patient dyad. The idea became fundamental in the subdiscipline of medical sociology. By the 1990s, the concept had almost disappeared from the research literature. Beyond the generational and theoretical changes that explain how the sick role idea could become irrelevant or unnecessary to sociologists, there were two immediate factors: the negative politicization of the concept and the shift of medical (...) sociologists to a focus on applied health behavior. A generation or more ago, as the Cold War flourished, the continental European\nscholars whom I met seemed odd to me. They were, virtually without\nexception, totally preoccupied with whether their scholarship harmonized\nwith Marxism or refuted Marxism. This focus cut across disciplinary lines.\nIndeed, a basic assumption united these colleagues: the scholars’ world,\nwhether Karl Marx or Max Weber, consisted of centralized bureaucracies\nsuitable for socialism or at least for orderly organization.\nNorth American scholars shared with the Europeans, not the preoccupation\nwith Marxism, but the idea that (...) centralized bureaucracies made up the\ninteresting world. In such a world, the human sciences were disciplines, and,\ncontrary to Michel Foucault, the discipline was applied to the scholar. The\nscholar was expected to search for empirical evidence and to interpret the evidence\nas objectively as was humanly possible. The human science disciplines\nhad identifiable functional structures, and most scholars (perhaps excepting\nsome anthropologists) tended to be structural functionalists. (shrink)
